As an accredited rail operator it is important that you understand your responsibility for reporting railway accidents and incidents.

Under the Rail Safety Regulations 2006, Part 6 it details the requirements of an accredited rail operator in reporting to PTSV.

This covers a rail operator’s requirement to:

  • notify the Safety Director of PTSV immediately after becoming aware that a railway accident or incident has occurred
  • give the Safety Director a record of the railway accident or incident within 72 hours afterwards
  • notify the Safety Director of PTSV in writing of a notifiable circumstance that has occurred in relation to rail operations for which the operator is accredited within 72 hours after becoming aware of a notifiable circumstance

Investigation reports

A rail operator must prepare an investigation report and provide this report to the Safety Director as soon as practicable after finalising the report. The report needs to contain the relevant information as specified in the Regulations for a railway accident or incident of a severity level set out in the Regulations.

Monthly reports

As a condition of accreditation a rail operator must give the Safety Director of PTSV a monthly report that details various statistics as outlined in the Regulations.

Exemptions from reporting requirements

An accredited tourist and heritage railway operator may apply to the Safety Director, PTSV for an exemption from the requirement from submitting a monthly report.
